WHO PROTECTS THE CITIZENS

I think that Miami would be the natural location for a new novel to follow-up on George Orwell’s famous Animal Farm, where all the animals were equal, but some animals were more equal than others.


Unlike Orwell’s novel this one wouldn’t have to be allegorical, in fact, it wouldn’t even need to be a novel. 


Just a straightforward accounting of what happens in Miami on regular basis would be enough, or perhaps too much, since telling the truth in this case wouldn’t make anyone “free.”


Among the principal characters should be the members of the Miami-Dade Commission On Ethics and Public Trust. They personify much that’s wrong about the political culture in Miami, especially when it comes to establishing PUBLIC TRUST.


As members of this august body their role is “to serve as the guardian of the public trust by, among other things, educating the public,” and by setting the “standards of ethical conduct and enforcing those standards of conduct.”


They are, therefore, the standard bearers of ethics behavior and PUBLIC TRUST for our community, and like Caesar’s wife should be above suspicion.


To be caught in a flagrant violation of Florida’s Sunshine Law only serves to underscore what a growing number of people believe about this group of people, and that is that they are both incompetent, and prejudicial in their actions.


If the photograph above had been published on the front page of any major newspaper in Florida 10-15 years ago I have no doubt that it would have generated a huge outcry out outrage from a lot of average citizens because it shows 3 members of the Miami-Dade Ethics Commission; 2 lawyers, one a 23 year retired Circuit Court Judge, the other a University of Miami Law Professor, and the woman, the director of a prestigious Florida International University department on Labor Relations engaged in holding what amounts to a secret discussion during the course of a public hearing.


The incident occurred on September 3rd, and in addition to a number of other ethics commission attorneys in the room, there were approximately 10-12 members of the news media present, including reporters from the Miami Herald, El Nuevo Herald, and reporters from all of the local channels affiliated with the national networks, CBS, NBE, ABC, Fox, and several Latin channels as well.


NOT A SINGLE ONE OF THESE REPORTERS RECOGNIZED THAT A VIOLATION OF FLORIDA’S SUNSHINE LAW HAD OCCURRED IN FRONT OF THEM, AND CONSEQUENTLY NOT A SINGLE ONE REPORTED ON THIS VIOLATION, EVEN THOUGH THE VIDEO FOOTAGE OF THE VIOLATION WAS CAPTURED BY ALL OF THEIR CAMERAS!


How can that be? Simple, just because all of these news channels go through an annual charade of proclaiming the importance of Florida’s Open Government Laws, few of these reporters care  or, I suspect, in many cases don’t even know what the law requires, nor do they seem to understand why the citizens of this state voted to make the Sunshine Law part of the state constitution.


When the folks who are entrusted to be the watchdogs for the citizens of Florida don’t know, or care about public officials flagrantly violating one of the cornerstones intendedto provide protection against the abuse of elected officials conducting public business in secret, then why would it be a surprise when the public displays an apathy and ignorance of what their elected officials are up to?


Last week, I filed an ethics complaint against the City Manager, all 5 members of the City Commission and the Chief of Police after the Chief, under oath, admitted that he had arranged to circumvent the provisions of the City Charter by encouraging the Commissioners to deal with him directly “on matter that interest them.”


I actually had one so-called reporter, after my little press conference at City Hall ask me in all seriousness why that was a problem.


Again, when you have no conception of what the reasoning or justification was for the majority of municipal governments in our country choosing a form of government that requires professional managers to run their cities and counties instead of politicians, and why the political interference and meddling involving elected officials is something that all well-managed municipal governments work hard to prevent, then what business do you have showing up at City Hall pretending you’re a “news reporter” covering government?


But the best part of all of this is that this same collection of unethical, Ethics Commission bozos are spending real time and effort to gin up the notion that folks in Miami-Dade County should celebrate “Ethical Governance Day,” and in doing so view them as leaders in this effort.


WHEN YOU BREAK THE LAW AS FRAGRANTLY AS THESE PEOPLE DID, THE ONLY CELEBRATION THAT THE CITIZENS SHOULD TAKE PART IN IS WHEN THESE PHONIES ARE REMOVED FROM OFFICE!


Now, I have no faith of that happening, because to accomplish that goal would require the involvement of the corrupt Miami-Dade State Attorney Katherine Fernandez-Rundle to take them to court.


Given the past evidence of her office’s refusal to prosecute politicians - especially politicians in the large cities in Miami-Dade County - for violations of either Florida’s Sunshine or Public Records Law, and also given that the Miami-Dade Ethics Commission is where former SAO employees like Executive Director Joe Centorino have gone to double-dip and cash on their previous “public service,” the notion that Fernandez-Rundle would ever prosecute a retired Circuit Court Judge, a University of Miami Law Professor and the Director of a prestigious FIU Department for violating Florida’s Sunshine Law, especially when it was my rights they violated, is way too much to ask or expect from someone whose more corrupt than the people she’s supposed to be prosecuting for public corruption crimes.


So, I’ve filed an Ethics Complaint!  Not that I have much faith that these people will judge themselves, given the piss-poor job they do in judging others, but the options are limited, and I want to see just how they handle having to investigate themselves for a change.
