FLORIDA BAR SAYS MY COMPLAINT  IS NOT VALID

Well, I’m sure it wasn’t personal, but last month I filed a complaint with the Florida Bar against Ms. Carmen Cabarga, the attorney for the CRA, for a failure to provide me the public documents I had requested, and for claiming that the documents did not exist.


As you can see, the Florida Bar disagreed.


I could have filed a lawsuit, but I was curious as to how the Florida Bar would deal with this issue, since there is a specific provision in the Rules Of Professional Conduct that deals with this kind of situation.  Here it is:


        “4-4. TRANSACTIONS WITH PERSONS OTHER

        THAN CLIENTS RULE 4-4.1 TRUTHFULNESS IN

        STATEMENTS TO OTHERS


        In the course of representing a client a lawyer shall not        

        knowingly:


        (a) make a false statement of material fact or law to a

        third person; or

        (b) fail to disclose a material fact to a third person when

        disclosure is necessary to avoid assisting a criminal or

        fraudulent act by a client, unless disclosure is prohibited

        by rule 4-1.6.


The Florida Bar in their wisdom, chose to ignore this provision, and ruled that Ms. Carbarga had not violated any of it’s rules.


It will be interesting to see how the Florida Bar reacts next week to my next Stupid Law Trick.
