On October 20th, the morning after I wrote my first story about the Downtown Development Authority (DDA) sending out what appeared to be over 39,000 questionable postcards soliciting city residents to apply for Absentee Ballots, Michelle Niemeyer filed an Ethics Complaint.(11)


On October 31st, after I had posted my last, and most comprehensive story about what the DDA had done, Michelle Niemeyer followed up her original complaint and sent Miami-Dade State Attorney Katherine Fernandez-Rundle the following email.

That same day, one of Rundle’s assistants sent the following email to her Chief Assistant, Jose Arroyo.

Arroyo responded the following week.

Rundle then followed up by writing to Joe Centerino, her former Head of Public Corruption, who is now the Executive Director of the Miami-Dade Ethics Commission..

On November 10th, Kate Callahan, another District 2 candidate wrote to Rundle.

This prompted Rundle to write to Centerino again.

Then Rundle wrote to Callahan and Niemeyer giving them assurance that she had turned it over to her former trusted aide Joe Centerino.

Just so everyone is clear on where we stand on all of this, here are some of the “facts” that we know about this incident.


FACT NUMBER ONE


Commissioner Sarnoff lied when on October 20th, Chuck Rabin reported that, “Sarnoff said he was unaware of the mailing campaign, adding that his campaign is “not touching any ballots.”


Both DDA Board minutes and audio tapes of 2 meetings reveal that Sarnoff chaired the meetings, and that he introduced Alyce Robertson at those meeting where she gave her Executive Director Report that included reporting on this project.


FACT NUMBER TWO


Carmen Cabarga, the CRA lawyer lied in an attempt to withhold documents that revealed that the CRA, under the direction of Sarnoff errand-boy Pieter Bockweg, instructed David Karsh - another Sarnoff errand-boy and former Sarnoff staffer - to be part of this “project.”


Numerous emails exchanged between Karsh, Javier Betancourt, Assistant Executive Director of the DDA, William Plasencia, current Sarnoff staff member and others on the design of the postcards and the logistics of getting them circulated spell out the efforts of the CRA to play a part in this scheme.


The below email establishes that fact unequivocally, and like so many other “projects” initiated under the direction and approval of OMNI CRA Chairman Sarnoff, this would have been a, illegal use of tax money intended to be used to eliminate “slum and blight.”

This report is but a part of the extensive analysis that I have been led to believe Martinez actually prepared with the information he received from the Miami-Dade Elections Board.


FACT NUMBER FIVE


Although the entire DDA Downtown District includes a total of 18,739 registered voters, the records indicate that the DDA paid for printing 42,000 Get-Out-The-Vote/Absentee Ballot postcards, and paid the postage to send out 39,085, thereby raising a question as to whether the DDA sent these postcards to the overwhelming majority of the 42,000 registered voters in all of District 2?


At the very least, the 6 non-DDA precincts, much less the additional 20,346 or so voters non-downtown/DDA areas of District 2 who received these postcards account for a sizable portion of the printing and mailing costs of this scheme.


Costs which if they were expended on non-DDA areas of the city represented would appear to be a clear misuse of DDA tax funds, since DDA tax monies are supposedly earmarked for expenditures inside the DDA boundaries.


IN CONCLUSION


These “facts” represent some of the highlights of the alleged illegal activity associated with the behavior of the DDA, the CRA, Commissioner Sarnoff’s staff member William Plasencia and the Commissioner himself in attempting to further the his reelection fortunes through this Get-Out-The-Vote/Absentee Ballot scheme, especially since almost 50% of the votes for the Commissioner came as a result of Absentee Ballots.


For many this would represent compelling evidence supporting a real investigation.  Unfortunately, a closer read of Rundle’s correspondence reveals that she has more or less divested her office of responsibility for pursuing an investigation by turning it over to the unethical Miami-Dade Ethics Commission, where her former long-time cohort Joe Centerino, now holds sway over establishing and judging the ethical standards of this community.


The alleged illegal acts committed in this scheme were criminal as stipulated by Florida Statute 106.15, 775.082 and 775.083, and as such merit being treated as crimes and not as some sort of ethical lapses.


I’ve repeatedly attacked the Miami-Dade Ethics Commission as being unethical, and the center piece of my allegations is real estate attorney Kerry Rosenthal, who as a 13 year member of the Commission I documented is both unprincipled and unethical.


Not only can you read the detailed evidence for my claims by clicking on the links above, but you should also be aware that Rosenthal is the real estate attorney for none other than Tibor Hollo, long a recipient of Commissioner Sarnoff’s munificence, such as bailing him out of a problem piece of real estate at 1814 Brickell Avenue, where a para-legal in Rosenthal’s office played a central role in shielding Hollo’s involvement from public view.


Hollo was also the recipient of an OMNI CRA $9 million tax credit deal on a piece of property next to his Opera Tower East of Biscayne Boulevard - a section of the OMNI CRA with ZERO slum and blight - that he was going to build a hotel on, which Hollo now claims to have rejected because of the possible arrival of the Genting Casino and Resort.


While Hollo might reject the deal now, the only reason he got it to begin with was because of Sarnoff’s approval of the deal as the OMNI CRA’s Chairman.


Additionally, Hollo’s son Jerome is a member of the DDA Board. How sweet and cozy is that?


These inter-locking relationships, the not-so-secret back room deals and especially the flow of campaign money that Fernandez-Rundle has already started receiving from folks on the DDA Board - like the fund-raiser held on November 3rd at the offices of Ackerman Senterfitt, where DDA Vice Chairman Neisen Kasdin is the managing partner - preclude any serious effort by her or her prosecutors, or Joe Centerino and the Unethical Miami-Dade Ethics Commission from building a case about how the DDA, the CRA, Sarnoff’s staff and Sarnoff himself illegally ordered and/or used money, time and effort to give Sarnoff a helping hand in his campaign reelection efforts.


The only way this will ever go past the “we’re looking into it” phase is if my prediction that Sarnoff has plans to get rid of Alyce Robertson comes true, and they set Robertson up as the patsy to take the fall.


Other than that, this is all a charade by a bunch of scummy political whores looking to circle the wagons and pretend in the end that nothing of consequence happened.


After all, it’s Miami, Bitches!

Upon review, 6 of those precincts ARE NOT WITHIN THE BOUNDARIES OF THE DDA, raising a question as to why they would have been included.


The precincts in question are 536,538,568,569,995 and 996. 


What 5 of these 6 precincts DO HAVE IN COMMON is that they have the highest concentration of high-rise condos in Commissioner Sarnoff’s district.


The electoral problems created by the building of these condos since the 2007 election is that of access to potential voters by candidates having to run the gauntlet of unfriendly, or biased condo boards.


These 6 precincts represented 9097 of the 18,739 registered voters the DDA through Martinez, claimed to be in their boundaries. These 6 precincts therefore represented 47% of the registered voters that DDA campaign computer whiz Nicholas Martinez sought information on in the above letter to use for his calculations in preparing his campaign analysis report.

FACT NUMBER THREE


William Plasencia, Sarnoff staff member, was, as revealed by the dates and times on the emails that I posted in my last story, engaging in these activities during the time that he was on the city’s time clock, thereby engaging in actions that would seem to violate the provisions of the Hatch Act, a FEDERAL CRIME.


FACT NUMBER FOUR


The rationale presented by the DDA for undertaking this supposed good government project was to stimulate increased citizen participation within the boundaries of the DDA.


In the copy of the email below to representatives of the Miami-Dade Elections Board, Nicholas Martinez, the former election computer whiz for the Leon County Supervisor of Elections, who the DDA hired in April for $68,250, requested the “voter file for 13 downtown Miami precincts.”

Somehow, last year at this time the city managed to get the payroll done in time without sending out all of these memos.


When you look at the level of professionalism, the quality of service, and the overall morale of city employees, you cannot but conclude that there has been a decline which can only be attributed to the incompetence and unprofessional managerial skills of those people now entrusted to run the city.


All roads lead back to Tomas Regalado.  He appoints the City Manager, and with each appointment he manages to appoint someone less competent and capable.

MIAMI AS THE POSTER CHILD

Monday’s Wall Street Journal did a story about the way that some cities and counties have been using restricted monies to finance other public services.


Miami, as usual, was the poster child for this kind of bad behavior.


The best line in the story was the last sentence where Commissioner “Ethics” couldn’t resist doing his Tomas Regalado impression.

Even in the craziest of times past the City of Miami Finance Department always managed to get the payroll out on time.  Last week however, for the first time ever the city failed to pay its employees on time.


Now, City Manager Johnny “The Doormat” Martinez and Pete Chircut, Interim Finance Director, are looking for outside reasons to blame for the screwup and asking for everyone’s cooperation.

HERE’S YOUR CHANCE TO TELL ME
TELL ME WHY I’M WRONG AND YOU’RE RIGHT

Over on Investigation Miami, someone posted a request that IM, me and other political bloggers and writers invite the folks we write about to present their side of the story by giving them a chance to write their own article.  Here’s what was posted.


        “IM, I like reading your stuff, but it seems that you

        and Crespo and the others that blog about politics

        only present your side of the story. Why don't you

        open your site up to let the people you write about

        present their side of the story. Supposedly there

        are always two sides of a story, and maybe once

        in a while it'd be nice to hear the other side.”


I’m game.


For instance, I’d love to hear from Jessica Capo about what her and Sergio Guadix were doing that afternoon that prompted her to kick off her shoes and have a beauty coma on the way back to the office.


I’d love to get the Mayor or Johnny Martinez to explain anything.  I think it’d be great to get Luis Cabrera to explain to all of the folks who work for the city, the news media and all the visitors why and how he decided to impose “The Crespo Rules” on entering the MRC building and responding to public records requests.


I’d love for all the people who refuse to respond to my public records requests - in a timely manner or otherwise - why they think it’s okay to shit on the Public Records Law.


I’d especially love to see Alyce Robertson and/or Nicholas Martinez explain why they decided that they needed to conduct a full-scale campaign analysis of the DDA District in order to encourage folks to vote, when groups like the League Of Women Voters seem to have made a career of  doing the same thing without all of the effort requiring specific voter information and campaign analysis reports.


Not only would I be interested in any explanations or comments from these folks, but I know that my readers and the tax payers would be interested in hearing from ANY of these people and others on how they spend public money and what they do on public time.


So here’s my deal.  If I’ve written about you and you’re unhappy with what I’ve written, then I not only welcome you, but urge you to respond if you feel aggrieved.  Give it your best shot.  You can either just write something and send it to me in an email, or you can get fancy and write something and include photos, audio, documents, copies of emails, you name it.  I’ll print what you send me uneditied.


The specs for that are that these columns are 403 pixels wide, and we can probably go to 15,000 - 16,000 pixels in length.


So that’s my offer.  Who know, maybe you’re right, and I’m wrong.  If I am, I’ve never had a problem making a correction when I’m wrong.  The only way we’ll know though is if you come out of the darkness and provide a reason for what you’ve done.


That’s the way democracy is supposed to work.

ISN’T HALLOWEEN OVER
HOW CAN YOU TELL MIAMI IS A BANANA REPUBLIC? TUESDAY’S ARE DRESS UP IN UNIFORM DAY

On Tuesday, the Miami Police Department staged a big ceremony promoting a handful of officers to higher ranks, and for all intents and purposes revealing that Manny Orosa considers himself the permanent Chief Of Police.


In September, Orosa was told not to undertake any major staff changes in advance of a new Chief being selected, but,  that was in September, and now we’re in November, and all the back-room deals have been agreed to, so Manny felt comfortable enough to stage this event.


Hint to all the folks who applied for the job of Chief of the  Miami Police Department.  Forgetaboutit! 


This is Miami, and the fix is in. His Ignorance, the Mayor isn’t letting anyone get near the Police Department who isn’t bought and paid for, and understands that like in any Banana Republic, the Police Chief is there to serve and protect El Caudillo.


Which brings us to Luis Cabrera.  Look up at the photo and you will see that Luis Cabrera is sitting among all the dignitaries - he’s the 3rd from the left, and next to Commissioner “Ethics.” 


Yes, your eyes are not deceiving you, Luis is wearing the dress Blue’s of the Deputy Chief of Police, but he was introduced as the Assistant City Manager, and a “guest,” at the event.


So, what’s up doc?


Is Cabrera an Assistant City Manager, or is he the Deputy Chief of Police?  he can’t be both.


Of course, there’s probably a reasonable explanation for this confusion.  Maybe Luis likes to play dress up at home, and just got so carried away with the fantasy that he forgot to change clothes before he went to the Police Department.


No matter what, the truest sign yet that Miami is indeed a real Banana Republic is Luis running around in a police uniform while supposedly being an Assistant City Manager.


I wonder when His Ignorance will show up at City Hall dressed as a Babalawo.
