NO PROBABLE CAUSE

IT TOOK ONE MINUTE AND 27 SECONDS FOR THE ETHICS COMMISSION TO AGREE WITH THEIR STAFF ATTORNEY THAT THERE WAS NO PROBABLE CAUSE IN MY COMPLAINT AGAINST VICTOR “BABY DADDY” DE YURRE  FOR LOBBYING COMMISSIONER MARC SARNOFF ON A ZONING ISSUE.  THAT’S NOT A CONCLUSION THAT THE RECORD SUPPORTS.

Last December I filed a complaint against Victor De Yurre, who Commissioner Marc Sarnoff had named during the October 24th Planning and Zoning meeting of the City Commission, when he invoked a Jennings Disclosure.


A Jennings Disclosure is when elected officials who are making decisions on zoning and planning issues have to  reveal if they’ve had any ex parte communication with an interested party associated with the project.


In checking the records after the meeting I discovered that De Yurre was not registered to lobby for the company involved, and because he had been mentioned by Sarnoff as being one of the people who he had spent an afternoon with looking over this project and it’s parking plans, I filed an ethics complaint for De Yurre’s failure to register as a lobbyist.


At February’s closed door session, the Ethics Commission took one minute and 27 seconds to hear the presentation made by the staff attorney recommending that there was “no probable cause,” and to agree with her.


It was a new speed record by the Commissioners who the audio tapes of their meetings reveal are quick to agree with staff when it comes to dismissing cases.


This time however, the printed and audio record reveals that the grossly incomplete investigation by Manny Diaz, the Commission’s investigator, and the biased and inaccurate presentation made by Miriam Ramos, the Commission’s Staff Attorney were the kind of work product that would merit a suspension, if not an outright termination in a real agency entrust with protecting the public’s trust.


I’ve come to rely and appreciate that Crespogram readers will take the time to read my stories, and the only way to make sense of what really happened in this case is to provide you the raw files as well as the letter that I have sent to Nelson Bellido, the new Chairman of the Commission.


You can do it several ways.  You can read the investigative report and listen to the audio tape of the Commission’s meeting, and then read my letter, or you can read me letter and then read the report and listen to the tape to verify that the claims I’ve made are truthful and accurate.
