On Tuesday, Katherine Fernandez-Rundle was probably hot enough to you know what after she read His Ignorance’s comments in the Miami Herald about Michelle Spence-Jones’  lawsuit.


If you missed it, here’s what he said:


        “This is an issue between her and the state attorney,”

        the mayor said, adding: “The fact is, I hope I’m called

        to testify under oath that I never spoke to Fernández-

        Rundle about Michelle Spence-Jones — ever.’’


You got to give it to Regalado, he’s consistent.  When I broke the story about the attempt to bribe Chief Exposito, he claimed he knew nothing about it, until he admitted that he did.


When I filed an Ethics Complaint for his failure to report his true financial assets, he claimed he was the poorest Mayor in the land, until he got tagged with an Ethics violation for not telling the truth.


Time after time, when first confronted with a crisis of some kind, the first words out of his mouth have been, “I don’t know anything about it,” when of course not only did he know, but often was the ring master of whatever crisis it was.


So here too Regalado has managed to put himself in a box. 


Can anyone actually believe that Regalado “never spoke to Fernandez-Rundle about Michelle Spence-Jones - ever.”


How do you think Fernandez-Rundle took the news that her pal Tomas, was trying to separate himself and essentially throw her under the bus?


After all, Regalado is still the Mayor, and his daughter is still on the School Board only because her office allowed him to walk away from the election campaign violations without charging them with committing a crime, like they clearly had every reason to do.


Besides going off like a Romam Candle, who do you think Fernandez-Rundle probably called immediately after she read what Regalado said?


COULD “THE WHOPPER” BECOME A “WHOPPER JUNIOR” BY THE TIME THIS STREET BRAWL IS OVER


A dollar to a donut says that she called the Phantom Mayor of Miami, Armando “The Whopper” Gutierrez, and that she probably read Gutierrez the riot act for Regalado’s comment.


Armando has been credited in some circles as being the one who lured Fernandez-Rundle over to the Dark Side some years back, and who, unlike Regalado, never meets with her at her office. 

It’s too early in the game for the rats to start trying to jump off the ship, so, if Gutierrez didn’t have enough on his plate trying to scheme and do everything he could to undermine the campaign of Francis Suarez for Mayor, now he’s going to have to do double duty and do everything he can to try and protect Regalado and Fernandez-Rundle from Spence-Jones, while at the same time, his wife will probably be left to handle the campaign duties. 


Regalado’s continued stay in office represents a meal ticket for a lot of people, not the least Gutierrez. If Regalado loses, “The Whopper” would no longer be at the top of the list of the lobbyists you need to hire to get things done at City Hall.


By the time this is all over, poor Armando could lose enough weight from all the running around he’s going to have to do, that he could downsize himself from a full fledged Whopper, to a Whopper Junior.


THE TOOTH FAIRY DID IT


Whispers have it that Maria Chiaro is claiming that she’s as pure as Snow White when it comes to who provided all of the damning information from inside the City Attorney’s Office to Spence-Jones.


So, since Maria says she didn’t do it, and because there’s no reason not to believe her, then we’re left with the possibility that the Tooth Fairy did it.


Don’t believe in the Tooth Fairy?  Shame on you. 


THE ISSUE OF WHO’S FOOTING THE BILL FOR SPENCE-JONES’ LAWSUIT


I’ve heard from folks on all side of this issue, the majority weighing in with the belief that the  New York lawyers are doing this more or less for free for the publicity and possible payday if they win.


That could very well be the case, but I’m still of the mind that even if the New York lawyers, and the Harvard Professor are willing to do this, there are still a lot of hard costs associated with this lawsuit starting with the travel costs associated with these folks coming and going from New York to Miami.


Of course, as you read the Complaint it would appear that many of the potential witnesses mentioned have probably already been spoken to by Spence-Jones’ lawyers, and the burden of deposing these people to find out what they have already said, or will say at trial will fall on Fernandez-Rundle and Regalado.


One guy who I definitely can’t see doing this for free however, is local attorney Ray Taseff.  As a local criminal attorney, he’s a guy who has to depend on a certain amount of good will with the folks at the State Attorney’s Office - for those of you who might have forgotten, Mr. Taseff was the attorney for Thomas Kroeger, who I wrote about regarding the Missing Engagement Ring story -  and being the local attorney in a major RICO Civil Rights lawsuit against the State Attorney isn’t necessarily the best way to keep up those relationships.


I know that if all things were equal, and even if they weren’t, if I needed a criminal lawyer right now and had to chose between getting one who was involved in suing the State Attorney on a RICO Civil Rights claim, or one that wasn’t, I wouldn’t hire the guy who was suing the State Attorney.


People who need criminal lawyers have enough problems of their own without deciding to buy into to someone else’s problems, so unless I get a certified, notarized letter from all the lawyers saying that they’re doing this because they LOVE Spence-Jones, and not for the money, I’m sticking with my claim that someone(s) with deep pockets could likely be coming up with the money to finance this deal.


One possibility could be Martin Margulies, who has deep pockets, and who was the one identified as forming Spence-Jones’ first Legal Defense Fund in 2007.  This was the “Blind Trust” Fund that led to the opinion from the Ethics Commission about her not being able to receive money from a “Blind Trust” Legal Defense Fund.


I wrote Commissioner Spence-Jones asking her whether she has set up a Legal Defense Fund, but she hasn’t answered. 


I’m sure that long before this is all over, we’ll get to the bottom of how all this is being paid for, on all sides.


STRANGE BEDFELLOWS


Of all the intriguing tidbits in the Spence-Jones Complaint, the one I found really interesting was this claim that:


        “(210) Regalado summoned Bru to a secret meeting

        at City Hall, on the weekend of November 14-15, 2009.

        (211)Such a meeting was unprecedented.  (212) At the

        meeting were Regalado, Bru and a City Commissioner  

        (213) At the meeting, Regalado pressured Bru to disregard

        the Miami Charter and opine that the Commission, even

        absent a quorum, could appoint a commissioner to fill

        Spence-Jones’ seat. (214) Bru refused.”

                      

On that day, there were only two sitting City Commissioners: Frank Carollo and Marc Sarnoff. Spence-Jones was gone.  Francis Suarez had yet to win the runoff for Regalado’s old seat, and Angel Gonzalez had been removed, leaving Willie Gort to be elected in January.


So, who could have been that City Commissioner? Carollo or Sarnoff?


For any number of reasons, not the least of which would have been his own desire to see Spence-Jones gone from the City Commission, I think that unnamed Commissioner was our pal, Commissioner “Ethics” Sarnoff.


So, I wasn’t joking in my last piece when I wondered whether Sarnoff had written himself another memo, like the one he wrote over the Mercy Hospital meeting.


Consider what happened as soon as Spence-Jones was ousted, and The Reverend/Commissioner Richard Dunn was appointed to represent the folks in District 5.


In what has got to be one of the all time classic bitch slaps, Sarnoff wasted no time in moving to strip the OMNI CRA away from Dunn’s control, and did so with words that should be included as the preamble of every document that deals with the formation of a CRA.


        “The history of how these CRA’s have been governed

        is that everyone who’s ever chaired them has been

        arrested, has been indicted, and has been found guilty

        of something.”


Imagine, this came out of the mouth of none other than Commissioner “Ethics” himself.


Here’s that portion of Sarnoff statement from the minutes of the February 11, 2010 Commission Meeting:

Given these sentiments and the bad blood between them over the Mercy Hospital allegations Sarnoff made in his memo, there is no reason not to believe that in November of 2009, after Spence-Jones had been charged and arrested, that both Regalado and Sarnoff felt confident with the idea that Fernandez-Rundle would take care of their Spence-Jones problem, and that it was this belief that gave Sarnoff the comfort level to make the claim that he did about all of the District 5 Commissioners being crooks.


Now, 2 years later, we find Sarnoff and Spence-Jones joining forces with Francis Suarez in his efforts to unseat Regalado.


Being the suspicious minded person that I’ve become after two years of turning over rocks in the City of Miami, I’m wondering whether Spence-Jones pulled punches by not focusing more on Commissioner “Ethics’” role in working to keep her from returning to the City Commission.


They might have a tolerate-hate relationship, but Sister Spence-Jones seems to have the tunnel vision ability to figure out where the main chance lays in any equation, and zeroing in on that, even when it leaves her ass hanging out like a hospital patient wearing one of those flimsy hospital gowns.


Teaming up with Sarnoff could be risker than being the frog who gives the scorpion a lift across the pond.
