THIS ACTUALLY HAPPENED WITH AT LEAST 5 LAWYERS EITHER ON, OR WORKING FOR THE ETHICS COMMISSION IN THE ROOM

If you have followed this blog for any length of time, you will know that I have written often - 21 times before now - and critically about the behavior of the folks on the Miami-Dade Ethics Committee.


I have argued repeatedly that they have violated my rights, disrespected my complaints, and generally shit on the Rule of Law.


I would have never believed however, that even after all the times that I have written about these people, and more importantly, shown up at their meetings with a video camera, that they would be either so stupid, brazen, or both, to flagrantly violate the Florida Open Government Law in front of me and a room full of TV cameras at last week’s hearing on my complaint against Commissioner Frank Carollo.


It’s a revelation of how little any of these people either know or care about the law, that I was able to record what you are about to view.


CRESPO THE “CRIMINAL”


When I showed up at the Miami-Dade Ethics hearing on September 3rd, I was caught by surprise that unbeknownst to me, Frank Carollo’s defense would be predicated in part on referencing to my criminal past, and was handed a copy of a Motion For Limine prepared by the Ethics Commission Advocate Michael Murawski.


The motion was an effort by Murawski to stop Carollo’s lawyer Benjamin Kuehne, Commissioner Carollo, and Police Chief Manny Orosa from using my history as a bank robber as part of Carollo’s defense to challenge my credibility in filing my complaint.


Here are the relevant parts of that motion.


“3. The instant complaint was filed by Albert Crespo. Mr.

Crespo is not listed as a witness in this case and was not a witness to the incident.


4.During his deposition, Respondent referred to the complainant as a “convicted bank-armed bank robber.”  In the deposition of another witness, the complainant was referred to as “a criminal.”


  1. 5.The reputation and/or character of the complainant is totally

irrelevant to the facts of the case.  The public hearing in this matter should not be an opportunity for the respondent to publicly denigrate the complainant.”


Imagine, Michael Murawski trying to defend me against being denigrated by the likes of Carollo, Kuehne and Police Chief Manny Orosa? 


I understood the strategy behind the motion and was touched by Murawski’s effort because he could have just let this slide, but those warm and fuzzy feelings soon left when I watched the discussion that followed.

The Miami-Dade Ethics Commission is a quasi-judicial agency, and is subject to Florida’s Sunshine Law, which means that every word uttered by any of the members during the time that they are engaged in Commission business must be uttered in public, or recorded so that the public can listen to what they say during executive meetings.


No matter what they said behind the Blue folder, or out of the range of the microphones, they were breaking the law when they said what they said.


Here’s what the Florida Government-In-The Sunshine manual says about this, and includes all of the various cases that support that standard being upheld.

Therefore, when the Commission members started discussing whether to support or oppose the Motion In Limine, and did so by shielding their conversation from the public, they committed an amazing and extraordinary violation of Florida’s Sunshine Law.

To appreciate just how amazing and extraordinary these two photos are, the man in the middle is Carlton Copeland, the Chairman, and a big shot law professor at the University of Miami.  The bald headed guy holding the Blue folder to shield his conversation is former Miami-Dade, 11th Circuit Court Judge Lawrence  Schwartz who spent 23 years on the bench, and damn sure knows about the Sunshine Law. 


To the right of the judge and not in the photo was Joe Centorino, Executive Director of the Miami-Dade Ethics Commission, and also a lawyer who for over 20 years was the head of the Miami-Dade State Attorney’s Public Corruptions Unit, and supposedly the county’s expert on Florida’s Sunshine Laws. 


Also not in the photo was Michael Murawki, the Commission’s  Advocate and Miriam Ramos, the Commission’s Deputy General Counsel.


Not a single one of these individuals uttered so much as a peep while this flagrant violation was going on.  I suspect that most of the folks in the audience, including all the TV reporters were also clueless, because no one really knows or spends much time in caring about this law, or about the public records law except for the annual press release that all of their stations read on the air to proclaim Florida’s commitment to the Sunshine and Public Records Law.


I knew what was going on, and sat there stunned as I watched this, because not only were these people violating the law, they were violating my rights, as both the complainant and a citizen - YES, I AM A CITIZEN OF THE UNITED STATE AND OF FLORIDA - and therefore entitled to all the rights and privileges of citizenship, including not being fucked over by these people.


As you can imagine, in the next few days I’m going to initiate some legal action against what happened here, and I know that you probably won’t believe this, but as bad as this was, something else happened at the Carollo hearing that will make this violation of the law look like a case of jaywalking.


Oh yeah, the Carollo hearing itself was also a hoot, and hopefully I’ll have a big package of stories ready by Friday about all of this.


In the meantime I want to thank Commissioner Carollo and his lawyer for deciding to go forward with this hearing.  You two guys have turned out to be like having a pair of pet Unicorns.


I owe this, the Chief calling his police officers “snitches,” and everything that’s coming down the road to your brilliant legal strategy!  Can’t wait till the hearing resumes.
