WAS THIS PHOTO DOCTORED
IT’S REALLY EASY TO PROVE ONE WAY OR ANOTHER

On August 21, 2012, as part of a sworn complaint that I filed with the Miami-Dade Ethics Commission regarding what I alleged was the illegal use of City vehicles by Commissioner Sarnoff, Suarez and Mayor Regalado, I included the above photo as an exhibit.


The important thing to understand is that in Florida, lying under oath during an official proceeding is “a third degree felony charge. Upon conviction, the defendant may receive a sentence of imprisonment for up to five years, a fine in an amount up to $5,000, or both.”


My complaint would constitute such a proceeding, because it initiated an official investigation and hearing.


So, I take this very, very seriously.


In the copy of the investigative files, and the dismissal of the complaint the report included the following:


        “Upon viewing the photocopies of the pictures supplied by

        Crespo as part of the complaint, Herbello noted that the

        photo appears to be possibly “photo shopped”; specifically,

        that his image appears to be standing very stiffly and the

        door seemed out of proportion in height to Herbello. 

        However, since this event occurred two (2) years ago

        and his interaction with the Mayor was very brief, he

        could not recall many specific details.”


For the record, I DO NOT “photo shop” photos. I am a nationally recognized, award-winning photojournalist, whose work has been in newspapers, magazines, and books, including textbooks,  around the world, and who among other things was the subject of a documentary that won 2 Emmys and numerous other awards.


When the accusation is made that one of my photos may have been “possibly “photo shopped,” or doctored to alter the appearance of an individual, that affects my professional reputation as a photojournalist.


Therefore, here’s the deal, Major Herbello.


I will provide a copy of the folder with all of the images that I took at the “Ladies In White,” protest, include the image above, to any qualified Photo Shop expert.  You can choose the expert, as long as it’s a real Photo Shop expert . 


If that expert says that the image was NOT doctored to make you smaller, the SUV door larger, or you standing stiffer than you appear in the original photo, then I want a FULL WRITTEN APOLOGY, and you pay the expert.


If the expert says that the image IS doctored, I will pay for the expert, AND I will make a sign apologizing to you, and I WILL STAND IN FRONT OF THE MIAMI POLICE DEPARTMENT FOR A WHOLE WEEK CARRYING THAT SIGN.


You can claim that you might not recall many of the events of that afternoon, but you cannot, and I will not stand by and let you claim, that the photo of you standing at attention waiting for the lobbyist Armando Guterriez to get out of the City SUV was “possibly “photo shopped,”” because it makes you look like a little, ass-kissing toady.


You did that all yourself!
